1847                           CHAPTER 35.
AN ACT declaring tho Louisa Fork of Big Sandy river a navigable stream.
Be it enacted by the General Assembly of the Commonwealth
of Kentucky, That the Louisa Fork of Big Sandy river, from
its junction with the Russell's Fork to the Virginia State line,
be and the same is hereby declared a navigable stream.
Approved January 16, 18,17.
CHAPTER 37.
AN ACT to abolish the benefit of clergy.
WiERAS, doubts exist whether the benefit of clergy is re-
pealed as to slaves convicted of capital crimes in the State of
Kentucky: and, whereas, it is probable that, owing to these
doubts, there will be a difference in the administration of the
criminal laws in the different Judicial Districts of Kentucky.
For remedy whereof,
Be it enacted by the General Assembly of the Commonwealth
of Kentucky, That from and after the passage of this act, no
slave or slaves, Indian or mulatto, or any other person what-
ever, shall be exempt flora punishment by, or on account of,
the benefit of clergy; and that all laws allowing the benefit
of clergy to any slave or slaves, or to any other person what-
ever, shall be and the same are hereby repealed.

CIIAPTER 46.
AN ACT to decl.-,  Whippoorwill a navigable stream.
Be it enacted by the General Assembly of the Commonwealth
of Ifentucky, That Whippoorwill, from its mouth to the Doub-
le Licks, in Todd county, be and the same is hereby declared
a navig;able stream ; and all persons obstructing said stream
shall be liable to all the pains and penalties to which persons
are subject for obstructing navigable streams in this Common-
wealth, and collected in the same way: P'ovided, That the
provisions of this act shall not be so construed as to apply to,
or interfere with, any mill dam that may have been, or that
may hereafter be, erected across said stream: Provided, also,
That it shall not be so construed as to apply to, or interfere
with, any bridge or bridges that now are, or may hereafter be,
constructed across said stream.
Approved January 20, 1847.
