1845     rendered in the cause of Moses Maxfield and wife, against
their children, the court shall have an order eniered direct-7
ing the commissioner, in said cause, to invest the funds in
his hands (the proceeds of the sale of the, fifty five acres of
land sold by him under the decree aforesaid,) in land in Ken-
tucky; and so much of said act, to which this is an amend-,
ment, as directs that said funds shall be invested in laod in the
State of Illinois, is hereby repealed.

CHAPTER 247.
AN ACT pro% iding for a change of venue in the prosecution against Ned, a
slave.
SEc. 1. Be it enacted by the General Assembly of. the Corn-
monivealth of Kentucky, That a change of venue is granted
May elect to Ned, a negro man slave, the property of Thomas Doran,
to be tried in for the tral of an indictment for an attempt to commit a rape
ilart.
upon the body of Sally Kennedy, now pending against the
said Ned in the Hardin Circuit Court, upon the election and
consent of the said Ned, on the calling of said indictment at
the next term of the Hardin Circuit Court, being entered
upon the records of the Hardin Circuit Court, that ie prefers
to be tried on said indictment in the Circuit Court of Hart
county.
SrE. 2. When the said Ned shall have mad, his election to
Duty Judge be tried in the Hart Circuiut Court, then, and in that event, it
of Hardin Ct. shall be ihe duty of the Judge of the Hardin Circuit Court to
Court.      make all necessary orders, and do all things necessary, to
secure the appearance and trial of the said Ned, on said in-
dictment, in the Hart Circuit Court.
SEc. 3. That when the indictment in this case shall have
HartCt.Ct. been removed from the Hardin to the Hart Circuit Court, and
its duty.,  the prisoner committed to the jail of Hart county, or recog-
nized to appear at the Hart Circuit Court, should he be ad-
mitted to b, il, then the said Hart Circuit Court shall have as
full power and jurisdiction to hear and deterinine the afore-
said indictment as though the same had been found, originally,
in said court, and the offence charged had been there com-
mitted; as, also, to require the attendance of witnesses, as
well on the part of the Commonwealth as the said Ned, and
to renew their recognizances, and to do any and all other
things requisite to ensure a fair, impartial and speedy trial, on
said indictment. It shall, also, be the duty of the Judge of the
Hardin Circuit Court, to recognize the witnesses of the Coln-
monwealth, and the witnesses of the said Ned, to appear, at
the same time, in the Hart Circuit Court, to testify against
said Ned, on said indictment, and the prisoner's witnesses on
his behalf.
