1842     1540, be, and the same is hereby, released to the said Benja-
min Wickersham, and no execution shall thenceforth issue
upon said judgment against said Wickersham: Provided, that
nothing in this act shall be construed so as to release said
Wickersham from the costs of suit.

CHAPTER 339.
AN ACT for the benefit of Nicholas L. Oliver, late Sheriff of Henry county.
WHERlEAs, it is represented to the General Assembly, that
Nicholas L. Oliver, former Sheriff of Henry county, through
misfortune, was prevented from paying into the Treasury of
this Commonwealth the full amount of the revenue due from
said county for the year 1840; and, whereas, the said Nicho-
las L. Oliver has heretofore, and since execution has issued
against him, discharged the principal part of said debt, and is
prepared to discharge the remainder--therefore,
Be it enacted by the General Assembly of the Common-
wealth of Kentucky, That the said Nicholas L. Oliver be, and
he is hereby, released from the payment of all interest and
damages due on the above debt, and the Second Auditor of
Public Accounts is hereby directed to issue to said Oliver a
quietus, on proof being made that the principal of such execu-
tion has been fully paid by him, or some one for him.

CHAPTER 340.
AN ACT to reduce into one and digest and amend the acts and amendatory
acts incorporating the city of Lexington.
SEC. 1. Be it enacted by the General Assembly of the Corn-
Boundary of monwealth of Kentucky, That so much of the county of Fay-
city defined.  ette as is contained within the following bounds, to-wit: one
mile from the court house in every direction, shall be, and
hereby is, declared to be a city, and the inhabitants thereof
are created a body corporate and politic, with perpetual suc-
cession, by the name and style of the City of Lexington,
Corporate and as such, by that name, shall be capable in law of contract-
powers.    ing and being contracted with, or suing and being sued, plead-
ing and being impleaded, answering and being answered unto,
in all courts and places, and in all matters whatsoever; and
may have and use a corporate seal, and change, alter and re-
new the same at pleasure.
SEC. 2. That the fiscal, prudential, and municipal concerns
Mayor and of the said city, with the government and control thereof, shall
council to be be vested in one principal officer to be called the Mayor, and
appointed, and one City Council, consisting of twelve persons, to be denomin-
