Be it further enacted, That the rate of tolls herein Owingsville specified shall not be applicable to the Owingsville and Big andSandyroad Sandy Turnpike, or to any other graded road upon which there is but one gate for each ten miles thereof, but the same. shall remain as at present, subject to such change or modifica- tion as the Board of Internal Improvement may deem best calculated to promote the public interest, and that of the stockholders. SEc. 8. Be it further enacted, That the Board of Internal Improvement shall have power, and they are hereby author- Roads may ized, to let, or lease out, for a term of years, not less than be leased. three nor more than seven, for the best price they can get, the road last aforesaid, together with the gates, if, in their opinion, the interest of the stockholders will thereby be pro- moted without detriment to the public, or the respective com- munities through which the road passes, under such rules, regulations and restrictions as they may deem best calculated to insure the object contemplated by this act. SEC. 9. Be it further enacted, That it shall be the duty of the Board to bind the lessee, or lessees, to keep the road in Bond of les- good repair, and pay to the stockholders a net dividend, over see. and above the cost of repairing; taking bond and good secu- rity for the performance of his or their obligation; the amount which may be due to the Public Treasury, to the credit of the Sinking Fund, and the amount which may be due to in- dividual stockholders, to be paid, in like manner, to the respec- tive individuals, or to the Treasurer of the Company for their benefit. SEC. 10. Be it further enacted, That in making the con- tract alluded to, the board shall reserve to itself the right to Board may rescind the same, for any refusal or failure on the part of tile rescind con- lessee or lessees, strictly to comply with the provisions thereof, tracts. of which the board shall be the sole and exclusive judges, and their decision shall be final and conclusive. SEC. 11.
