1841       SEc. 1. Be it enacted by the General Assembly of the Com-

be subject to a fine of five dollars, with costs, for every such
offence, recoverable before any Justice of the Peace in the
county where the offence has been committed, at the instance
and in the name of either the President, Engineer, Superin-
tendent, or any Director or Stockholder in said road; the
fine, when recovered, to be paid over to the Treasurer, for the
benefit of said company.

son violating this provision shall be subject to a fine of five
dollars, for every such offence, recoverable as in section first,

no fine shall be collected of any person for the detention of
his vehicle, detained by accident or misfortune, upon the road,
until a reasonable time shall have elapsed, after such accident,
to remove the obstruction.
SEC. 3. That, after the passage of this act, it shall be the

of roads,   road, to post up, at each toll gate, in some conspicuous place,
a list of the nuisances and offences, prohibited by this act,
with the penalties annexed. It shall also be the duty of the
Superintendent, to notify, in writing, any person who has
thrown embankments, timber, or any other obstructions, in
any ditch, drain, or culvert, on the section or division of road
over which he has supervision, to remove the same within
three days after receiving said notice; and, upon his or her
failing or refusing to do the same, the said Superintendent,
Engineer, or person, having care of said road, may cause the
obstruction or obstructions to be removed; and the costs of
the removal may be recovered of the party offending, as in
section first of thiq art.
