1840.    COt~ . 121.-AN ACT to arnend the charter of the city of Lexington, and for
1840.other purposes.
SEC. 1. Be it enacted by the General Assembly of the Com-
monwealth of Kentucky, That the jurisdiction of the City
Jurisdiction Judge of the city of Lexington shall extend to all cases of
of City Judge riots, routs and unlawful assemblies within the county of Fay-
extended.   ette as hereinafter provided. That whenever he shall be ad-
vised, or receive information, on oath, of any rout or unlawful
assembly of tile people for the purpose of gambling, or any
unlawful purpose whatever, whether such assembly shall con-
sist of freemen or slaves, or of both, it shall be lawful for him
to issue his warrant to arrest all such offenders, directed to
any Constable or Sheriff of tle county of Fayette, or the
Marshal of the city; and if no officer is at hand to serve the
warrant, then to such discreet person as he shall appoint, re-
turnable before some Justice of the county-on which war-
rant it shall be the duty of the officer, or other person, to ar-
rest and to bring before the said Justice of the Peace of the coun-
ty of Fayette, all persons who shall be so found assembled, to
be dealt with by the Justice as may be according to law.
SEc. 2. That it shall be the duty of the citizens of the city

SEc. 3. That whenever the Mayor of the city shall be ad-

law, or where the said assemblage shall or may be constituted
of partly white and partly of black population, it shall and
may be lawful for the said Mayor, with the power of the
county, (if required,) to proceed to the place of such rendez-
vous or unlawful assembly, with his Marshal, or other officer
or officers, and to arrest all persons so unlawfully assembled,
and to forthwith bring them before any Justice of the Peace
of the county, to be dealt with according to law.
SEC. 4. That it shall not be lawful for any free white per-

so offending, shall make fine to the Commonwealth, to be ap-
propriated as other fines are, any sum not less than ten nor
more than one hundred dollars, at the discretion of a jury;
and on failure to make payment, shall be committed to the
city work house, to be confined at hard labor at the rate of
time of one day for every dollar, and the costs of the prosecu-
tion so assessed.
Siec. 5. That all the powers now vested by law in the
