Be it enacted by the General Assembly of the Corn- monwealth of Kentucky, That the Trustees of the town of The Trustees Winchester, and their successors in office, shall, as heretofore,a body eorpo- be a body politic and corporate, and shall be known by the name and style of the Board of Trustees of the town of Win- chester, and by that name shall be capable in law of contract- ing and being contracted with, of suing and being sued, plead- ing and being impleaded, and do all other acts, matters and things which a body politic, having perpetual succession, can lawfully and rightfully do and perform: they shall be elected How & when annually, on the first Monday in June, by the free white male elected. inhabitants of said town, over the age of twenty one years, who shall have been bonafide residents of said town at least six months before said election, and shall have paid their poll tax for the preceding year, (whether the same hath been charg- ed by the Assessor or not) and also have paid all arrearages and taxes due by them to said town, which upon being ques- tioned must be satisfactorily proved: The said Trustees shall hold their office one year, or until their successors in office are duly elected and qualified; take the oath now prescribed by law, and cause vacancies in their body to be filled as heretofore How vacan- directed, declare any member of their body to have vacated cies are to be his seat upon his removal from the town, or disqualification as filled. such by law; they shall appoint one of their own body Chair- Chairman to man of the Board, to preside at all meetings of the same, and be chosen. in his absence shall appoint a Chairman pro tempore, and in case of his death, removal from the town, or vacation of his seat as Trustee, appoint another of their body in his stead: The election of Trustees, as aforesaid, shall be con- Election,how ducted by two members of the Board appointed for that pur- conducted. pose, and take place at the court house, in Winchester, and the return of the names of the persons elected shall be made to the Clerk of the Board, to be by him recorded in the Trustees' book of record: No suit or prosecution shall be instituted suit against against said Board of Trustees except in the county of Clarke, the b'd, where and the service of process upon the Chairman of the Board tobe institutad. shall be sufficient; and it shall be the duty of said Trustees to cause their by-laws to be strictly enforced in the said town, and also to have the general laws of the State, the enforcement of which, either in part, or in whole, devolves upon them fully and faithfully complied with. SEC. 2.
