1840.    and with such surety, or sureties, as, in the discretion of said
court shall seem right, for his appearance in the Adair Circuit
Court, on the first day of the term of said court, next succeed-
ing the date of such recognizance ; and in like manner to re-
cognize the witnesses in said case, for the Commonwealth, for
their appearance in said Adair Circuit Court; and when said
change of venue shall have been ordered, as contemplated by
this act, it shall be the duty of the Clerk of the Russell Circuit
Court forthwith to transmit to the Clerk of the Adair Circuit
,Court, the indictment, and all papers filed therewith, together
with a full and complete copy of all orders and recognizances
entered of record in said court ; and when the same shall be
filed with the Clerk of the Adair Circuit Court, the case shall
be placed on the docket of that court for trial ; which court
shall, when the venue is changed, and the papers filed in the
Clerk's office of said court, as directed by this act, have as full
Jurisdiction power and jurisdiction to hear and determine the same, as
.given.     though the alleged offence had been committed in the county
of Adair, and the indictment found in the Circuit Court of said
county ; and the said court shall have power to make all such
orders, and take such steps to procure the attendance of wit-
nesses for the Commonwealth, and for the defendant, as to said
court shall seem right; and if it shall so turn out, that said
McMillen is not put upon his trial in said court, by reason of
any steps by him taken in said case, may require and take
from said McMillen, a recognizance for his appearance again
in the said Russell Circuit Court, as herein provided; it shall

after be tried in the said Russell Circuit Court, for said alleged
offence ; and if the said Adair Circuit Court shall, as herein
provided, direct the change to the said Russell Circuit Court,
it shall be the duty of the Clerk of said Adair Circuit Court
forthwith to transmit the papers in said case, and such orders
as may have been made in said court, to the Clerk of the Rus-
sell Circuit Court, who shall, on receipt thereof, place said case
on the docket of the court, for trial, at the first term of said
court next after the papers in said case shall have been receiv-
ed by said Clerk.
