any person or persons guilty of the act aforesaid, shall be pro-  1840.
ceeded against by indictment of the grand jury for the coun-    -
ties aforesaid, and shall be fined, at the discretion of a jury, any
sum not less than one hundred, nor more than three hundred
dollars.
SEc. 2. That the Constables in their respective districts, in  Constables to
the counties aforesaid, shall be authorized, and they are here- call outcitizens
by required, upon their own knowledge, or the information of in their district,
others, that the said woods are on fire, forthwith to proceed to and penalty for
failing to at-
summon all the tithables, in their said districts, or as many tend.
thereof as he or they shall deem sufficient, and go with and
command the same until said fire shall be extinguished; and
the said Constables, for each day they are so employed, shall
receive one dollar and fifty cents, to be paid out of the county
levy of the county; and for failing or neglecting to comply
with the provisions of this act, shall forfeit and pay the sum
of ten dollars for each failure, recoverable before a Justice of
the Peace, by warrant, in the name and for the use of any in-
dividual who may warrant for the same.
SEc. 3. That each and every tithable, in said counties,
neglecting and failing to obey the summons of such Constable
or Constables, of their district or districts, shall be subject to
the same fine and same proceedings as in cases of failure to
work upon public roads in said counties.

CHAP. 247.-AN ACT for the benefit of Edward Donoho.
WHEREAS, it has been represented to the presentGeneralAs-
sembly, that Edward Donoho was some years ago convicted, by
the Madison circuit court, to the penitentiary for the knowing-
ly receiving and selling a stolen slave; that said Donoho served
out his time, and conducted himself well during his confine-
ment, and that he has since he was discharged, for a series of
years, given renewed evidence of his honest and correct de-
portment: and, whereas, it is further represented, that since
the conviction of said Donoho, it has become the settled opin-
ion of the neighborhood where the act for which he was con-
victed transpired, that he was overreached and tricked into
its commission by others more cunning and culpable, who have
gone unpunished; and that Donoho is of honest and respecta-
ble parentage and connection-wherefore,
Be it enacted by ?he General Assembly of the Commonwealth
of Kentucky, That said Donoho be, and he is hereby, restored
