conferred by said acts are hereby granted to the
present corporation.
Sc . 4. He it further enacted, That Thoma3 Speed,
Books to be James M. Brown, Wilson Bowman, James M.
opened.    Wright and Thoma3 P. Lynthacum, be, and are here-
by appointed commissioners to open books at such
timo and places as they may think proper, for the
subscription of stock in said oompany.

CH&P. 438.-AN ACT to authorize the taking of depnsitions of
certain Ofieers of this Commonwealth, and the Officcrs of
Banks, to be read in chief in common L w suits.
Be it enacted by the General Assembly of the Com-
monwealth of Kentucky, That hereafter the deposi-
tion of the governor, trcasurer, auditor, register and
secretary of state; and also, of the president, cash-
ier, teller and clerk oi any hank, may, uFon legal
notice given, be taken to be read in chief in any
common law suit, dcrending in any court, except
the courts that may be held in the county, in which
such per:;ons way be resident: Providrd, That the
party to the suit cprositc to the one taking such de-
lositionr, may, at Iii, own costs have a continuance,
if he ha3 used due diligence to procure the attend-
ance of such pcr.-on, and his presence bo necessary
to a fair trial of the case.
