Rouse's presenting to the judge of the Henderson  1827.
Circuit Court, an account of the monies expended
by him in the recaption of the said criminals, to-wit:
Samuel C. Sugg, and a colored man called James
Stuart. that it shall and may be lawful for said court,
(satisfactory proof thereof being made,) to allow said
account, and to certify the same under his hand and
seal, to the Auditor of Public Accounts, who shall
thereupon, draw his warrant upon the Treasurer
therefor, which the Treasurer shall pay to said Rouse
upon the production of said certificate: Prorided horv-
ever, nothing in this act shall be so construed as to
authorize the judge of. said court to grant said certi-
ficate, if it shall appear that said criminals escaped
from the jail of Henderson county, through the neg-
ligence of said James Rouse, as jailor as aforesaid.

CnAP. I3.,-,-An act for the benefit of the devisees of Hugh Emi-
son, deceased.
WHE*REAS, it is represented that Hugh Emison,
deceased, made a will, vesting the whole of his es-
tate in devisees, and'that it is necessary to dispose of
a part of the estate for the payment of debts, and
that it would be to the interest of the children of the
deceased, to have a part of the real estate sold for
that purpose: Therefore,
Be. it enacted by the General Issembl5 of the Common-
wealth of Kentucky, That it shall and may be lawful
for the devisees of said'Hugh Emison deceased, the
infants acting by their next friend or guardian, to pe-
tition the Scott' Circuit Court, to decree a: sale of
such-part of the estate of said Hugh as shall be suf-
ficient to pay the debts chargeable upon the devisees
and' thereupon it shall be the duty of said court to
inquire into the amount of debts die by the devisees,
and what portion of the estate can be best spared to
pay the same; and to decree a sale of such portion
of the estate, whether it he land or negroes, or both,
for the purpose of paying the debts, as shall, in the
opinion of the court, best promote the interest of the
children of the testator. And the court shall'appoint
a commissioner to make sale of that portioru of ths
egtate decreed to be sold, and shall take bond and
