WHEREAS it is reprosented.by tie admina-
istrators or Alexander Ashby deceased, that he
Preamble.  departed.this life, possessed of sundry tracts of
land, and several slaves, but considerably in-
debted ; that his personal estate exclusive of
his slaves, is inadequatl to the payments of his
debts ; and that it would be more beuieficial to
his children, ten in number, that one of hii.q
tracts of lands, rather than his slaves, should
lie sold for the payment of his debts : and it is
further represented that the sale of two hundred
acres of le .nd; lying on Pogue's creek, in the
county of Hopkins, of which the said:Ashby t.ied
seized, would be sufficient for the discharge of
his debts, and that the said -tract will not in-
crease in value, while the inmpiovements there-
on will fall into ruin ; Wherefore,
Sec. 1. Be it ciacted by the.Gencrul A'ssembly
Circuit court of the Commonveallh of KAntuckiy, That it shall

cree the m-le of ered, upon the petition of the admitistrator. of
Laid of AsIby the said Ashby, tiled in the said court, to that
to pay debts, effect, and uponl the exhibition by said adminis.
trators, of such proof by affidavits or otherwise,
as will satisfy said court, that it ,vould be mot
advantageous to the children and heirs of said
decedaut, that the tract of land aforesaid, rather
tham the slaves aforesaid, should be sold for the
payment of his debts, to decree the sale of the
said land fbr that purpose, at such length (if
credits, and under such modifications of caution
in relation to the interests and security of th
children and creditors of the decedant, as may
in their sound discretion scent requisite.
