Be ijenad by the general afernbly, that if any,: parfon be convi6ted of breaking rPinwt ,- into any dwelling houl'e, or any part thereof *,k ,'I in the day time, or into any out houfe be- tay ai,. longing to and tifed with any dwelling houfe, and feloniouly taking away any mo- ney, goods or chattles, being of the value of five hflillings or upwards, although no per- Fln thall be in thefaid houfe or out houfeat the time offuch felony committed ; or if any perfon be convi6ted of aiding, counfelling, or abetting any perfon in committing fuch offence,; he fhall undergo a confinement in the jail and penitentiary, for any period not lefs 'than one year, nor more than five years. § .
