ventiOn Ajfrmb/ed; do ordain and eflablah this Conflitutionfor its Government.
A R T I C L E        I.
I. THE powers of government fhall be divided into three diftin& departI
.J  ments, each of them to be confided to a feparate body of magiffracy,
to wit; nlofe which are Legiflative to one, thofe which are executive to another
and thofe which are judiciary to another.
§ 20 No perfon or colledion of perfons being of onc of thefe departments, fihall
exercife any power properly belonging to either of the others, except in the in-
ftances herein after expresfly permitted.
§ 3- The iegiflative power of this comnionwbaitli ffhallbe vefed in a General
Aireibbly, which fhall confift of a fenate arid houfe of reprefentatives.
§ 4. The Reprefentatives Ihall be chofen annually, by the qualified eleaois of
each county r'efp ic6tiveiy, on the firft Tuefday in NJ ay; but the feveral elediong
-may be continued for three days, if, in the opinion of the prefiding officer or of-
ficers, it fhall be neceffaryi and no longer.
§5. No perfon ihall be a Reprefentative, who ihall not hav attained the age of
twenty four years, and have been a citizen and inhabitant of the State two yearg
.next preceeding his ele&ion, and the laft fix mbnths thereof an inhabitant of the
,county in which he may be chofen; unlefs he fhall have been abfent on the publid
,bufinefs of the United Sates or of this State.
6. Within two years after the firit meeting of the kicieral alfhmbly, aid ,ith-
in eveey fubfequent term of four years, an enumeration of the free male inhabitants
above twenty one years 'of age, Ihal be made in fuch manner as may be diteftect
,by law; The number of reprefentatives Ihall at the feveral periods of making
fuch enumeration be fixed by the legiflature, and apportioned among the feveral
counties, according to the number of free male inhabitants above the age of'
twenty one years in each, and flhall never be lefs than forty nor greater than
one hundred ; but no county hereafter ereaed, flhall be entitled to a feparate re
prefentation,. until a flufficient number of free male inhabitants above the age of
twenty one year s, fhall be contained within it, to entitle them to one reprefonta-
tive agreeable to the ratio which fhall then be eftablilhed;
§ 7. The fenators fliall be chfen for four years.
§ 8. Until the firf enumeration be made, the fenate fhall confift of even memm-I
bers, and thereafter for every fou r membei-s, added to the houlb of reprcfent
atives, one member fhall be added to the fenate;
§ 9. !n chufing the fenate, one member at leafi fhall be eiected frdm each coun;
ty, until the number of counties is equal to the number of fenators i after which,
when a new county is made, it flill as to the choice of fenators, be confidered a
being a part of the county or counties from which it flall have been taken.
§ io. Thefenate fhallbe chofen in the following manner ; All perfons qualifi-
ed to vote for reprefentatives, fhall on the firft Tuefday in May, in the prefent
year, and on the fame day in eveiy fourth year for ever thereafter, at the place,
appointed by law for chufing reprefentatives, eletl by ballot, by a majority of
votesi
