Be it enacted, <tj., That if any person shall be guilty ofrnon.1. stopping up, or obstructing, any public road of said State, upon in- ,'r formation received by any commissioner or overseer of any district rid. wherein said road is obstructed, shall notify the person obstructinglin ci1- the same to remove the obstruction, and upon failing to do so, shall be subject to be indicted for malicious mischief; and upon convic-renaty, Anti tion, shall be fined or imprisoned, or both, at the discretion of thelnent Court.
