An .dct to appoint the persons herein named Commissioners of the town of Preston, and to authorize an election to be held in the county of Milton,for a Clerk of the Superior and Inferior Courts, and Ordinary for said county, and for other purposes. 102. Section I. Be it enacted, That from and after the passage Comrx ap of this Act, George M. Hay, John W. Easters, William H. Allen, pomse& James G. M. Ball and Henry W. Spears, and their successors in of- fice, shall be and are hereby made commissioners of the town of Preston, the county site of Webster county, and shall be known by the name and style of Commissioners of the town of Preston; and c'rp'eaame by such, their corporate name, shall sue and be sued, plead and bea anhich inaysue aid impleaded, and do all other acts relating to their corporate capacity,be sued,etc. and shall have and use a common seal, and shall be capable in seal. law, to purchase, hold, receive, enjoy, possess and retain to them and their successors in office, for the use and benefit of said town ofMay'purck's Preston, in perpetuity, or for any term of years, any estate, or eS- and hold tates, real or personal, lands, tenements and hereditaments, of what s r kind soever, within the limits of said town, and to sell, alien, ex-o , . change or release the same, or any part thereof, in any way what- el ever; and the said commissioners, or their successors in office, shall have full power and authority to pass all by-laws and ordinances Maypanau respecting the streets of said town, to open, improve, or lay out the a'f, gt same, respecting public buildings, work houses, public houses, =Ift- pumps, wells, care of the poor, suppression of disorderly houses, wo' seo, regulation of negroes and free persons of color, and every by-lawpumpetc. regulation or ordinance that shall appear necessary and proper to them, for the security, wellfare and interest of said town, or preserv- ing the peace, health, morals and good government of the same; Vrorsg. provided, su' h rules, by-lws, and ordinances are not repugnant to the constitution and laws of this State. 103. See. II. And be it further enacted, That L. F. Birdsong is clerk. hereby appointed Clerk, J. W. Jassey, Treasurer, of said town ofTreame, Preston, and that the fees and salaries of said officers are to be fixed Their s1lu and regulated by the by-laws and ordinances of said commission- and fel ers. 104.
