by authorized to exercise a sound discretion in determining
to what classes of bonds the funds hereby set apart and ap-
propriated shall be annually applied.
SECTION 3. And be itfinther nactCd by hw authority ofore-
said, That any surplus which may be in the Treasury over
and above the appropriations made by the General Assem-
bly for that year, be and the same is hereby appropriated
to the purpose, and under regulations set forth in the pre-
ceding sections.
SECTION 4. And be itfurther enatcted by the authority afore-
said, That his Excellency the Governor cause all bonds re-
deemed by this act to be cancelled and filed away, to be ex-
hibited to the General Assembly or Financial Committee
next in session thereafter.

AN ACT to provide for the trial by the Superior Courts of
this State of any slave or slaves or frce person of color
charged with any capital offence against the laws of this
State.
SrCTIoN 1. Be it enacted by the Senate and House of Rep-
resentatives of the State o/ Georgia in General Assembly met,
and it is hereby enacted by the authority of the same, That
from and after the nassage of this act, whenever it shall ap-
pear, ather Investigaton, to the Justices of the Peace before
whom any slave or free persons of color shall be put upon
trial, for any offnce against the laws of' this State, that the
said slave or free person of color has committed a capital
offence, such slave or free person of color shall be imme-
diately committed to the jail of the county wherein such of-
fence was committed, if sufliciently secure, and il'otherwise
to the nearest secure county jail, and the Justices before
whom such examination shall have taken place, shall re-
duce their opinion to writing, and transmit the same, to-
gether with the report in writingof the evidence taken before
them on such examination, and all other papers appertaining
to said charge to the Attorney or Solicitor General, being
the prosecuting officer in the Superior Court of said county,
on the first (lay of the next terma of said Couit.
SECTION 2. And be it fitrther enacted by the authority afore-
said, That upon receiving the papers in any such case as
provided in the prcceeding section, it shall be the duty of
such Attorney or Solicitor General to fraune and send before
the Grand Jury a bill of indictment against the person or
persons so charged, as in cases of free white persons; and
it shall and may be lawful for the Grand Jury in any county
