Be it cnaeted bq the Senate and 1Iouse of Representatives of the Stateof Georgia, in General Assembly met, and it is hereb enarled b3 Ih aulhoritof the saw, That from and after the pussingI of this act ti %l ilful anIad imlic-iomus huin ig, or set- ting fire to,or attempting to hurn a house in a city, town or villige, when conunitted by a slave or free person of colour, shall be punished with death. Sec. 2. And be it fiurther enacted by the authorly aforesaid, That the wiltil and iilicious burning a diwelling house on a fhrin or phiantation, or elsewhere, (not in a city, toi i or vil- lage,) or the setting fire thereto in the niglt time when the, said house is actually occupied by a person or persons, with the intent to hurn the same, when committed by a slave or free person of colour, shall be puished with death. Sec. 3. And be it finther enacted by the authori~y afore- said, That the tril of offeiders against the provisions of this act, shall be h:id in the same courts, and conducted in the same manner and under the same rules and regulations as are provided by the several acts now in force in this State, for the trinl of capital offences, ien committed by a slave or fie person of colour. Sec. 4. And be- itfurther enacted, That all laws, or parts of lals, nub1litat:ing against this act, be, and the same iF hereby repealed. WARREN JOURDAN, Speaker of the House of Representatives.
