Sec. S. Andbe it further enacted, That any slave, or any person in the employment of others, shall violate this act, it sIiall be pie- sumptive evideince of the same being -lone by direction of the owner or employer: Provided, that no peison shall be punished or such presumptive evidence slone, otherwise than by fine ; but if it shalt satisfactorily appr ar that such offence was not committed by the di. rection or assent of such owner or employer, then the person actual- ly committing the offence, shall be liable, if a white person, to tint and punishment as provided by this act, and if a persmn of color, to such punishment as the ordinances of the said town may have irnpo. sed ; but vothing in this act shall prohibit the exercise by the Iniferi- or court of their ordinary and legal jurisdiction, in laving out and opening, or altering ncemsary roads, or shall restrict the said cot po- ration, or any legal authority, from diggmng any neces ary drains or canals, or shall be held to restrain, or abridge in othei respects than herein mentioned, the authority of the agent, for the tie being, of thp public reserve.
