Src. 3. And be itfurther uacted by the authority afore-
said, That whenever a new road ii thought necessary to he
laid out and estnlished by the Inferior court of said coni-
ty, it, shall be the duty of the said court to appoint three
disinterested freeholders to assess the damage, (if any,)
the person or persons will suslin by said road's going
through his or their inclosed land, which amount so asses-
sed shall be paid -by the court, provided the road or roads
are laid out by the order of said court.

Be it enacted by the Senate and House of Representa-
