U8Ji &N ACT To ameod the several acts establishing a Mayor's Court in the city of of Augusta, and also the several lawn incorporating said city. lie it enacted by the Senate and House of Representatives of th State of Georgia in General Assembly met, and it is herebyj enacted byj the authority of the same, That from and after the passing of this act, the Mayor's court for the city of Augusta shall have cognizance and jurisdiction of all cases of a civil nature, not involving title to real estate, where the defendant or defendants shall reside within the limits of said city, and the debt or demand shall be over thirty dollars and not exceeding three hlidre1dioflars, whether the plaintilf or plaintilh shall reside within said city or elsewhere, or whether the demand shall have accrued within the same or otherwise. Provided, always that nothing in this act or the acts to which it is anendatory shall be so construed as to authorise the said Court to maintain jurisdiction in any case where a corporation or body politic is a party. Sec. 2. And be it further enacted by the authority aforesaid, That in case either party in any cause tried by a jury in said court, shall be dissatisfied with the verdict of the jury, such party may within three days after the adjournment of said court, or during its sittine, enter an appeal to the Superior court of the county of Richmond, before the Clerk of said Mayor's court, upon the game terms, conditions, and re. gulations as are prescribed by law for the entry of appeals from ver- dicts in the Superior court, and it shall be the duty of said Clerk to transmit the record and papers of file in relation to such cases to the clerk of the Superior court at least ten days before the sitting of said Superior court, next to be held after the entry of such appeal. And it shall be the duty of the.Clerk of the Superinr court aforesaid to re- ceive and enter all such appeals on the appeal doelquet of said Court, and all such cases shall be tried by a special jury, in the same manner and under the same rules, regulations, restrictions, limitations and pe- nalties as if said appeals had been entered in the Superior court, and fus~al process shall issue in like manner. Sec. 3. And be it further enacted by the aldhor-,/ irutctr(ild, That the sale day of the sherill'of said city shall be on the 1r t funday in the month. And in all cases of levy on real esiate or negr.o., the timc of advertising and all other proceedings shall be the same as is required by law of the county sherifls in sihilar cases. Sec. 4. 1nd be it further enacted by the authoity aforesaad, That the said Mayor's court shall not maintain jurisdiction of' more than one case at the same term between the same parties where such caus- es can be legiily joined in one action, although the same may be on differont contracts ; but the same shall, on motion, be consolidated, and the defendant shall not he bound to pay any more cost than would have accrued on one action ; and when on such consolulation the amount demanded shall exceed the jurisdiction of said court a heiein before expressed, the plaintiff shall be non suit. .35
