WILLIAM RABUN, Governor., AN ACT To amend the Penal Code of this State. FIRST DIVISION, PERSONS CAPABLE OF COMMITTING CRIMES. SEC. 1. A or misdemeanor shall consist in A violation of a public law, in the commission of which there shall be an union or joint operation of act and inten. tion, or criminal negligence. 2. Intention will be manifested by the circumstances connected with the perpetration of the ofrence, and the sound mind and discretion of the person accused. 3. A person shall be considered of sound mind, who is neither an idiot, a lunatic, or alllicted by insanity, or who liath arrived at the age oif fou or before thatiage, if such, rson know the distinction between good and evil. 4. An infant under the age of nine years, whose ten. der age renders it improbable that he or she should be impressed with a proper sense of moral obligation, or of sufficient capacity deliberately to hrve committed the offence, shall not he considered or found guilty of any crime or misdeneanor 5. A lunatic or person insane, without lucid int -vals, shall 'not he found gnilty of any crime, with which tic or she may be charged-Provided, the act so charged as criminal. have been pommitted in the condition of such lunacy or insanity.
