Be it enacted by the Senate and House of kRepresentatives of the State of Georgia, in General Assembly nt, and it is enacted by th. authority of the same, That the several crimes and offences herein after particularly enu me- ,rated, are hereby declared to be felony-that is to say:-If any slave, free negro, Indian, mulatto or mustizo, (Indians in amity with the United States excepted) shall be guilty of homicide of 'any sort,, upon any white per- son, except by misadventure, or, if a slave, in defence of his or her owner, or other per- son under whose care and governmet such slave shall be, or shall raise oi attempt to raise any insuirection, or commit or attempt to commit any rape on any white person whom- shever, every such offender or offenders, Lis and their aiders and abettors, shall upon convic- tion thereof, suffer death ; or if any sidve, free negro, Indian, mulatto or mustizo, (except
