Be it enacted by the Governor and Legislativd Counci of the Territoryj of Florida, That all the free white inhabitants -.own in. residing within the limits of a line drawn east and west, com- corporated inencing at low water mark on the North Beach, and running west to the river St. Sebastian, so as to include Bar creek; thence along the western shore of said river to its mouth ; thence cast to the'eastern edge of the southern sand bank, at the entrance of the harbour; thence north to intersect the first line on the north beach at low water mark; and their successors be, and are hereby declaregAp:be a body politic and corporate, by the name and style of the ctwy of St. Augustine, with all the riglkts, liberties, privile- ges, powers and authorities incident to, and appertaining to acor- poration, body politic, or natural person, and by the said name and style, may sue and be sued, plead and be impleaded, hold, possess and enjoy, real estate, and personal property, and dispose of, and transfer the saie, and so dispose of, and manage the. fnnds of said city, as shall be most beneficial to the interests thereof. See, 2. Be it further enacted, That the government of the $Ihyor and sald city shall be vested in a person, to be called the mayor, and 'alde nen. four aldermen, to compose a council for the management of the afitirs of the city. The said mayor and aldermen shall be elect- ed annually on the second Monday of November, from amongst the qualified voters of sald city. Sec. 3. Be itArther enacted, Thatthe said council shall have power and authority to pass all laws and ordinances, that may be ,necessary and expedient for the good government of said city, and the preservation of the public morals; Provided, that they are not inconsistent with the constitution and laws of the United States, and the power hereby granted, and prohibit and punish By.1-aw%, offences against the public peace: Provided, no law or ordinanco in this respect, shall be inconsistent with any law of this Territory, They shall especially have power to regulate, improve, alter and extend the streets, lanes, avenues and public squares, and to open new streets, and cause encroachments, obstructions, decayed buildings, and old ruins to be removed, making the parties in- j ured by any improvements a just compensation, and charging up- on those benefitted, a reasonable assessment) to be ascertained in such manner as shall he agreed upon by tile parties, or by ajury of twelve men, to be wrganized in such manner, as by ordinance the said council may provide. They shall have power to. pre- vent and abate nuisances, to order and compel the owners or oc, 4upants of lots upon which pools of water are, or are likely to accumulate, to fill them up: regulate and compel paries by or- dinances, or otherwise, to erect and keep in repair partition felt- ces, and may pass :all laws and ordinances, that may be necessary tp preserve the public health.
