Ie.' sue-writs of Ficri Facias, upon all judgronts awarded to i-ue as 96a its ray, be aftbr. by the ciourts, of which they are clerks respectively, is. uju mmut dr soon as may be, after the udjournm.nt of said courts court. and not before, unless the plaintiff, his agent or attorney shall tiiki oath, that he, site or they has oi have good -reason to believe the defendant will remove his' her or their.property,from this Territory, before the same can be levied upon, in the usual nu~mn&r; then, and in that eCsp, it shall and may be lawful for said writ of Fieri 1?acias to issue, by order of court, immediately after Pl'naymaj judgment is entered :, Provided, tht in all-ca.es the execution. 1pltiintif' may delay the issuinlg of execution in his, her or their own cases as long as i, she or they may think proper, by leaving with the clerka mzemorandumtothat effect; Sec. 2. Be it furher enacted, That any person, hay - ibg a right to an execution from any court of record in Fi. . m this Territory, may order the same to be directed to the directed tothe marshal of the several districts of this Territory, if from marshals, &c. a superior court, or to ihe sheriff or'other proper ofitcer, thouihoutth as the.case may be, of any county of this'Territory, when Territor.
