'(an act to provide for the punishineit of crimes alid
misdemeanors, approved January 19, 1827, be, and
the same are hereby, repealed.
Sec. 2. Be jit Jurther cilacted, That tile act entitled
an act to define crimes and misdemeanors, and to pro-
flevva| of  scribe punishmepts For tile same, approved Deeember
act of 1824  28, 1824, except the one hundred and tenth, and the
one hundred and thirteenth sections thereof, and except
so much of tile said act as relates to the punishment by
stripes, be, and the same is hereby, revived and de-
clared to be in full force.
Sec. 3. Be it further enacted, That whenever (he
said act, approved l)ecember 28, 1824, and which is
runishmint hereby revived imposes a punishment by stripes for
of stripes t any offence therein diesiguted, I le same may be in-
be imposed  flicted at the discretion of tile court, to any nuul)cr not
by court   exceeding thirty-nine.
Cases of lar-  See. 4. Be itfitrlher enacted, That all cases of lar-
ceny not   ceny not expressly provided for in the act which is here-
provided for by revivei , shall hereafter be punished by stripes, not,
El, sied  exceeding thirty-nine.
Cases under  Sc. 5. .Ad be it further cnacted, That all crimes
former act to committed under the act approved January 19. 1827,
be pun;shed shall be prosecuted and punished nder the provisions
thercunder. of the same, as though it had never been repealed.
