Concerning fRoads, Ilighways and Ferries.
.De it enacted by the Governor and Legislative Coun-
cil qf the Territory of'oridarThat all the roads  in the
t er-several counties in this 'erritory, that have been laid

etc.           ties of this Territory, now established or hereafter to
be established, shall have Cull power and authority on
application, to order the laying out o1' any pal)lic road
or roads throughout their county, when the same shall
by them be deemed necessary, and to d iscontitnue such
public roads as now are or shall hereafter be found
usoless, burthcnsome, and inconvenient, and to alter
the roads now, or hereafter to be established, as often,
as occasion shall require.
2. Be it urther enacted, That whenever a petition
shall be presented to the county court signed by twelve

tain place theicin specified, it shall be the duty of such
court thereupon, if Ihe petition shall appear reasona-
ble, to appoint not less than three nor more than fi'c
commissioners, any three of'whom s',all have power
to act, which said commissioners shall be househol-
ders resident iii said courty, not intertsfed or living in
the direction the road is to be run out. And the baid
commissioners shall respectively take an oath before
Peocecdlingthere, any judge of the cou rt or justice of the peace of' the
oil            said county to vieiv and mark out the said proposed
road, the nearest and most practicahle route, and to the
greatest ease and convenience of the inhabitants and
as little as may be to the prejudice of any person or
persons. And it shall be the duty of said commis-
sioners to proceed as soon as may be to lay out the
said road, and make a return thereof undet their
hands to the next court (noting thereon the distances
and coutses as near as practicable of such proposed
road) which return so made shall be filed, and the said
court shall thereupon cause the clerk to publish, by
ptttting up at the court house door of the proper coun-
ty, a transcript of the petition and return for the infor-
