repair any bridge or other improvements, the court shall require
by summons or otherwise three or more householders, citizens
residing in the vicinity of such works, who shall state on oath in
open court,the necessity and utility of such work or improvements,
upon whose testimony the court shall base its decision, and make
such appropriations as in their judgment the case may require.
SEc. 5. Be it further enacted, That the court shall appoint one
or more practical man or men, whose duty it shall be to super-
intend, receive such work, and upon his or their order, the
county treasurer shall pay to the undertaker, the amount ordered
by the court to be paid for such work, Provided, That if the in-
ternal improvement commissioner of said county of Prairie shall
have ordered or made a contract for any work to be done, he
shall have it completed, as the law now provides, and upon his
order the county treasurer shall pay the amount required.
SEc. 6. Be it further enacted, That all laws in conflict with this
act so far as the county of Prairie is concerned be and the same
are hereby repealed, and that this act shall take effect from and
after its passage.

AN ACT to prevent setting prairies on fire.
SECTION 1. Be it enacted by the General Assembly of the State of
Arkansas, That if any person or persons shall willfully and inten-
tionally, or negligently and carelessly, set on fire or cause to be
set on fire, any prairie or woods, or other grounds, such person
or persons shall be guilty of a misdemeanor, and upon indict-
ment and conviction thereof, shall be fined in any sum  not less
than twenty-five, nor more than five hundred dollars, and be im-
prisoned not more than one month.
SEc. 2. Be it further enacted, That if such offense be committed
by a slave, with or by the consent or command of his owner or
overseer, such owner or overseer shall be liable as in the preced-
ing section.
SEc. 3. Be it further enacted, That any person who shall violate
the provisions of this act, shall in addition to the fine so assessed
be liable to pay to every person, so by him injured, double the
damages sustained by him, to be recovered by action on the case
before any court having competent jurisdiction.
SEC. 4. Be it further enacted, That this act shall not apply to
persons setting fire to prairies, who shall give two days notice to
all the parties who may be affected thereby.
