such terms and at such time as she may think best, and that such
sile may be effected through any agent appointed by the said Re-
becca for that purpose.
SEc. 2. Be it further enacted, That saiid Rebecca be authorized
to sell said real estate, as provided for in the first section of this
act, at either public or piivate sale, as she may deem most expe-
dient.
SEc. 3. Be it farther enacted, That the said Rebecca shall not
be required by any of the courts of this state to enter into any
bonds whatever, for the proceeds arising from the sale of said lands
that she be permitted to collect and receive the same for the use
and benefit of said ininor, and carry such funds to the State of In-
diana, or elsewhere.
SEc. 4. Be it further enacted, That the said Rebecca is fully
authorized by this act to make and execute to the purchasher or
purchasers, of said real estate, a deed for the same with such clau-
ses of covenant and warranty as may be necessary.
SEC. 5. Be it further enacted. That this act shall take effect and
be in force from and after its passage.

An act to Incorporate the town of Monticello, in Drew County.

SECTION.                           S
1. Incorporates the town of Monticello,
in Drew county, and defines its
boundaries.
2. Qualifications of voters in said town
same as for members of General
Assembly.
3. Town officers, one mayor and four
aldermen, and such others as are
necessary. Election to be held 1st
Monday of March, 1853, and annu-
ally thereafter, for mayor and alder-
men, who shall hold office one year.
4. Said town a body politic and corpo-
rate, and to possess powers usually
granted corporations in like cases
5. Mayor and aldermen to take oath
within 10 days after election to
faithfully discharge their duties.
6. Mayor to constitute executive power
of said town, and his duties as such
defined.
7. Aldermen have power to pass all by-
laws and ordinances, for the regu-
lation of said town, not contrary to
the laws of this state; in cases of a
tie, mayor to give casting vote.
8 No one eligible to office of mayori
who is not a free white, 21 years of,

age, a resident of the town 6
months before his election, and a
free holder or householder in said
town.
9. Mayor and aldermen judges ofqnali-
fications and elections of their own
members, and to determine rules
for their own proceedings, &c.
10. Mayor, and in his absence, any
member to preside at meetings of
council; three a quorum.
11. Any member ofthe council selected
for that purpose, may discharge du-
ties of mayor in his absence.
12. Within 5 days after passage of ordi-
nance, clerk of said town to put up
copy in three public places in said
town.
13. All vacancies in office of mayor or
council to be filled by ordinance.
14. Fines, &e , recovered as council by
ordinance directs.
15. Town council to levy tax on real
and personal property; on refu-al
to pay said tax, mayor to collect as
other debts are collected before
Justice ofthe pelce; right of appeal
granted.
