SEC. 1. Be it enacted, by the General Assembly of the State of
Arkansas, That all the district of country contained within the fol-
lowing limits; to wit: Beginning in the middle of the main channel
of the Arkansas River, on the line between the Indian country and
the U. S., and running S, 600, E. 1500 feet from the bank of said
river, thence S. 450, 45 m. to government line, thence S. 530, 30' E.
2682 ft, thence north to north west corner of 16 section, thence east,
3960 ft, thence north 2640 ft, thence west 6088 ft, to the bank of said
river, thence in the same direction to the middle of the main 'Chan-
nel of said river, thence up the middle of the main channel of said
river to the place of beginning shall be and the same is hereby erected
into a corporate city forever, and shall be called, distinguished and
known by the name of the City of Fort Smith; provided, that the
territory in Crawford county on the southwest side of the Garrison ave-
nue be not included within the limits of said city except with the consent
of the inhabitants living on said territory, and that nothing within
this act shall authorize the corporation to issue scrip, Post notes, or
change tickets on the faith of said city.
SEc. 2. Be it further enacted, That the inhabitants of said city of
Fort Smith, laid out and extended as above are hereby constituted
one corporation and body politic by the name and style of the Mayor
and Aldermen of the city of Fort Smith, and by that name they shall
have succession, forever, may sue and be sued in all the courts of law
and equity, may purchase, hold, and receive property, real and per-
sonal within said city for public schools, for market houses, public
squares, streets, alleys, wharves, prisons, work houses, water works,
and gas-works, and may sell, lease, rent, and dispose of the same for
the use and benefit of the city, and they may do all other acts touch-
ing the same as natural persons, and may have a common seal, and
the same break, alter, and renew at pleasure.
SEc. 3. Be it further enacted, That the council shall consist of a
Mayor and nine Aldermen, who shall be elected by the qualified vo-
ters of said city, be commissioned by the Governor, and hold their
offices until their successors are elected and qualified.
