SEC. 4. The citizens of Arkansas shall have the right to navigate
said river, and use all the improvements thereof on the same terms
as the citizens of Missouri; the improvements on said river shall be
construed [constructed] so as to render the navigation thereof safe
and practicable from the north boundary line of this State to the
Buffalo shoals on said river, and the locks and dams shall be kept
in good repair by the State of Missouri; and if said locks, dams and
improvements shall not be kept in good repair by the State of Mis-
souri, the privileges conferred by this act, shall cease until said im-
provements shall be put in good repair.
SEC. 5. If any private property shall be overflowed or injured
by the erection of the dams authorized by this act, the State of
Missouri shall pay to the owners thereof the amount of damages
sustained by them, and it not otherwise adjusted and satisfied, the
amount of damages shall be ascertained by proceedings made [had
upon] a writ of ad quod damnum, issued from the circuit court of
the county in which the property is situated.  -
SEC. 6. The privileges conferred by this act shall continue to be
enjoyed by the State of Missouri for twenty-five years, if the navi.
gation from the north boundary line of this State to the Buffalo
shoals, on said river, shall be kept in good condition, and the im-
provements therein shall be kept in good repair, and after the expi-
ration of twenty-five years, the privileges granted by this act shall
be subject to the legislation of the State of Arkansas; this act shall
take effect from its passage.
