[No. 196.]             AN    ACT
To amend an act incorporating the Town of Eutaw, in the
County of Greene.
Section 1. Be it enacted by the Senate and House qf Rep.
resentatives of the State of .Alabama in General Asembly
convened, That from and after the passage of this act, no per- Retailing sp!-
son except such as are or may be bona fide licensed tavern timous liquors
keepers, shall be allowed in any manner or form, to vend any restricted.
ardent or distilled liquors, in less quantities than one quart, to
any person or persons whatsoever, within one mile of the
court house, in the town of Eutaw, in the County of Greene,
and for every violation of this act, the person or persons so
offending, shall be subject to indictment, in the Circuit Court of
said county, and upon conviction thereof, be fined in a sum not
less than five hundred dollars, and be imprisoned it, the coun-
ty jail of said county, for a term not less than threeptonths.
See. 2. Alnd be it further enacted, That the intendant and
council of the said town of Eutaw, shall have power to pass p .
all by-laws and ordinances deemed necessary for the purpose Corporation

tailing of spirituous liquors in said town, and such by-laws and
ordinances when passed, to enforce and execute by fine and
imprisonment, one or both at the discretion of the said inten-
dant and council: Provided, the fine for each offence shall not
be less than twenty, nor more than fifty dollars nor any im-
prisonment for a longer time than ten days for each offence.
See. 3. .And be it further enacted, That the said intendant
and council shall have full power to pass all by-laws and ordi- Power fur.

shops or other places, fitted up for trading, from trading or
