[No. 113.]              AN  ACT
Incorporating the Town of Dayton, in Marengo County.
Section 1. Be it enacted by the Senate and House of Rep-
resentatives of the State of Alabama in General .Issenbly
convened, That from and after the passage of this act, the South-
west quarter of Sectir n thirteen, the Southeast quarter of Section Lmt
fourteen, the Northeast quarter of Section twenty-three, and the Luts.
Northwest quarter of Section twenty-four, nil in Township six-
teen, Range four, East, in the Demopolis Land District, be, and
the same is hereby incorporated, under the name and style of be
Intendant and Council of the Town of Dayton ; and under that
name, they shall be liable to sue and be sued, may plead and be
impleaded, in all manner of suits, both in law and in equity;
may have and keep a common seal, and the same break, alter or
amend at pleasure, and in short, shall possess power to (to all acts
incident to bodies corporate; and may purchase, hold and dis-
pose of, for the b-nefit of said Town, propcrty, real, personal or
mixed, to the amount of five thousand dollars.
Sec. 2. qnd be it further enacted, That on the second Mon-
day of February next, or within thirty days thereafter, (of which
election there shall be at least five days' previous notice given, lectin.
by one or more public notices posted within the aforementioned
limits,) an clection shall be held for four Councillors, one In-
tendant and one Town Constable, who shall serve for one year,
and until their sticcessors are elected and  qialified: ant  the said
election rhall be conducted by S. .J. iiarris, 1t. 6. Cooke, Anson
Springfield, Thomas V. Price, J. 1). Catlin and Jameies T I1'. Tyr-
rell, any two of whoin shall hive power to apt, and shall giv e
certific.. q of election to the five prrsons who shall have received
the highest iinber of voles: Provided, said manage rs, beforie
they hld saitl elaction, shall take an oath before a Justice of the
Peace, to conduct the same nevordinig to law.
See. 3. .nd be it farther enacted, That all subsequent elec-
tions for Countcillors, in said Town, shall be coInducted by anly
two Councilmen, to lie appointed by the Board for that pu rpose,  u
on the second Monday in February of each year; anti if from
any cause said election shall not take place on the appointed day,
then the Board may appoint some oiher day, not exceeding thirty-
days from the said second Monday of February, for holding
said election. And all free white males, twenty-one years of
age, who have been for thirty days, next preceding the election,
residents of said Town, or any person who may be a freeholter
in said Town, shaIl be entitled to vote: Provided, ct least five
days' notice of said election shall be given, by public notice
posted within the limits of said incorporation.
