PREAMBLE AND JOINT RESOLUTIONS,
Of the General Assembly of the State of Alabama.
WHEIREAs' it is provided. in the second section of the fourth article of the
constitution of the United States, that  a person charged in any State with
treason, felony, or other crime, who shall flee from justice, and be found in
another State, shall, on deinand of the exccutive authority of the State from
which he fled, be delivered up, to be reiioved to the State having jurisdic,
tion of the crime: and whereas, certain citizens of the State of New York
have becit duly charged, by afhidavit, regularly made before a qualified ma-
gistrate of the Commonwealth of Virginia, with having feloniously stolen
and carried away from that Commonwealth, a negro slave, the property of a
citizen of Virginia, and have lied from justice, and taken refuge in the State
of Now York: and whereas, the executive authority of Virginia has repeat-
edly demanded of the executive authority of New York, the surrender and
delivery of' the persons thus charged; and the executive authority of New
York has refused, in open violation of the constitution of the United States,
and in utter disregard of public justice, to comply with this demand:
Be it therefore resolved, by the Senate and House of Representatives of
the State of .llabama in General Asscmbly convened, That the conduct
of the executive authority of the State of New York, in refusing to comply
with the demand of the executive authority of Virginia, is a violation of that
solemn constitutional compact to which all the States of this union volunta-
rily became parties-a disregard of public justice derogatory to the dignity
of any State-an insult to the State of Virginia, and a dangerous and alarm-
ing attack upon Southern rights.
Be it further resolved, by the authority aforesaid, That we view the
conduct of our sister State of' Virginia, in her demand upon New York, and
in the measure of self-defence and protection which she has subsequently
resorted to, as being in strict conformity with the principles of the constitu-
tion, and as absolutely necessary for the security of those rights guarrantied
to her by that sacred instrumhent : that during the whole progress of the
controversy, she has been calm, temperate, dignified; making no appeals
save to justice and the constitution-and inasmuch as we feel our interests
to be identical with hers in the great question upon which she is at issue
with Now York, we will make common cause with her, and defend and
support her in the stand she has taken.
