Judges. in this State, to hold their respective courts, iotwithstanding the ab.
sence of thl Judge or Judges of the County Courts, on the first day
of their regular terms, any law, usage, or custom, to the contrary

To repent in part an act in relation to Free Negroes and Persons of Color.
Section 1. le it enacted by the Senam an House of Repreacnta-
tirc.s of the State of Alabama in General Assembly convened,. That
the sixth and seventh sections of anl act entitled an act the more
effectually to prohibit Free Negroes and persons of Color, from en-
tering into and remaining in this State, approved February second,
one thousand eight hundred and thirty-ninc, be, and the same is
hereby repealed. Approved, Feb. 1, 1840.

To Incorporate the Trustees of Aluntpelier Academy, in the county of Lowndes.
Section 1. Be it enacled by the Senale and House of Represen-
talires of the Stale qf labr/ma in General Assembly convened,
That S. W. Bowie, Laban Warren, J. 1f. Robinson, W. 1t. Ilay-
good, .. II. Luckie, II. Ilaygood, Stewart Farley and N. 1\laynard
sl tt 1n1n their sttecessors itn office, he, and are hereby created a body poli-
tie and corporate in law, by the unmo and style of the Trustecs ao
M\ontpelier Academy; and by that name shall be capable in law to
have and keep a perpetual succession, to sie aInd be stted, plead and
be impleaded in any court or courts in this State: and shall also have
power to borrow money, receive donations and bequests, and pur-
Proprty.&c. chase and sell, and have and hold real estate and other property,
real, itmixed or personal, in perpetuity; the real estate so had and held
not to exceed the value of ten thousand dollars.
Sce. 2. And boil further enacted, That said body corporate, or
a mjority of the members composing the same, shall have authority
Niay pasl by. and power to pass all such rules, regulations and by-lavs, not incon-
tuws. sistent with the constitution and laws of the United States, and of
this State, as they shall teem advisable for the government of said
corporation, and the government and control of said Academy, and
all those persons who are now or may hereafter become connected
therewith; and shall have power to appoint, annually, at stated
meetings of said Trustees, one of their members President thereof,
rlliers. and also a Secretary, Treasurer, and other necessary officers, at their
own discretion, who shall hold their offices as shall be prescribed by
the by-laws of said corporation; but is hereby expressly provided,
that any officer shall be liable to removal at any time, by said cor-
poration, for malfeasance in office; and said corporation may have
