To incorporate the Town of Franklin in the county of Macon.
SECTION 1. Be it enacted by the Senate and House of Representativ es of tle
State of Alabama in General Assembly convened, That the Town of Franklin Incorporation
in the county of Macon, be, and the same is hereby incorporated.
SEC. 2. And be it ]ifrtfer enacted, That John W. Pou, William N. Sears
and John Kelly, and their successors in office, are hereby appointed commis- Town com.
sioners for said town; the said named commissioners to holds their office until mseoners.

SEC. 3. And be it further enacted, That the corporate limits of said town L
shall embrace one mile square of territory, to be laid out in such manner as poration r
may sccm right and proper by said commissioners.
SEC. 4. And be it furthcr enacted, That the aforesaid commissioners, and
their successors, shall have power to pass all such by-laws, ordinances and B7lnw's.
regulations for the government of said town, as to them may seem meet and
proper: Provided, the same be not repugnant to the constitution and laws of
this State and of the United States.
SEc. 5. And be it further enacted, That the said commissionors, and their
successors in office, shall be, and they are hereby constituted a body politic style at car
and corporate, and shall as such, be capable in law, to sue or be sued, plead paration.

personal estate, either by gift, grant, purchase or otherwise, to enure to and
for the benefit of said town.
SEc. 0. Ani be it further enacted, That all persons who may have resided

and who may otherwise be qualified to vote for members of the General As-
sembly, shall be deemed qualified voters for commissioners: Provided, that
a residence of three months in the State and ten days in the town shall be

To amond the Laws ih force in relation to Retnilers of Spirituous Liquors.
SEcTIoN 1. Bec it enacted by the .Senate and House of Representatives of
the State of Alabama in General Assembly convened, That every person who
may hereafter become desirous to obtain a license to retail spirituous It-
quors in this State, shall first produce to the county court of the county in Retatjcrs.

court, and pay the sum of twenty dollars in open court, for the use of the

SEC. 2. And be it further enacted, That all laws and parts of laws atitho-
rizing or requiring the clerk of the county court to grant a license, or any
other authority, to any person or persons to retail spirituous liquors during the
recess of the court, be, and the same are hereby repealed.
SEc. 3. And be it further enacted, That every person applying for a li.
cense as aforesaid, shall, in open court, take and subscribe the following
oath, viz: I do solemnly swear, or affirm, that I will not sell any spirituous
liquors to any slave or slaves, or purchaso any article or commodity f'om Applicant.
