Be it enacted by the Senate and House' of Represeh. leadsoftatives of the State of Alabama, in Gene-a 'Assembly convened, fanilies to.That it shall be the duty of ill the inhabitants of this State, being give esti. heads of families, and persons not belonging to any particular mates. family, torender a true and'fthithful estimate to the assessors of taxes in their rpspective counties; sich estimates from hends of white families (to be on oath) and contain an enumeration of the whole nuinber of inhabitaits belonging to his or her fmily, making a correct distinction between the number of white males over twenty-one years of age ; white males under twenty-orie years of age; white females over twenty-one. years of nge; white females tinder tienty-one years of age; the total of free people of colour (Intdians riot taxed excepted) and the total of slaves, Persons gi-. Sec. 2. Andbe it further enacted, That it shnll be the duty of ving in es- the assessor of taxes, in each and every county withip this state, tintes to to claim and receive of all heads of families and other persons t as described it, the preceding section, the estimate which they are therein required to firnish. Tie oatrequired'of the heads of families as aforesaid, shall be administeredby the said' as- sessor in each respective county, and in form as follows, to wit: You do solemily swear (or affirm as the case may be) that the estimpte which you now render', contains a true and fhithfuml enu- meration of the, number of inhabitants of which your family consists, with the proper distinction of sexes, age, and colour, to the best of your knowledge, so help you God. Penaltyfor Sec. 3. And be it further enacted, That if any person shall false re- fail to make a return of him or herself and family, or any part turn, thereof being thereunto requested by the said assessor, or shall . nowingly wake a false or improper return, he or shetshall be ned in the sum of fifty dollars, to be recovered before any jids- tice of the peace, or judge of the county court of the county, one half thereof to the us' of the informer, 'nd the other half thereof to be paid into the county treasury.
