Re: Funding Public School Recreation Programs
Under Utah Code Ann. S 11-2-1, et seq.
Informal Opinion Request No. 88-14
Dear Superintendent Moss:
This letter is in response to your request of April 14,
1988, dealing with establishment and funding of recreational
programs pursuant to Utah Code Ann. S 11-2-1 (1986) et seq. Your
precise questions are:
1. May a school district transfer responsibility,
funding, and sponsorship of athletic programs to a
recreation program established under Title 11,
Chapter 2?
2. May a school district use proceeds of a recreation
levy to purchase, construct, and equip facilities
for athletics and other recreational activities?
Generally, Chapter 2 of Title 11 authorizes cities,
counties and school districts to establish recreational
facilities and to operate all types of recreational and athletic
programs, Utah Code Ann. S 11-2-1 (1986). Such programs may
include tournaments and leagues among other community interests.
Utah Code Ann. S 11-2-2 (1986). Authority to supervise and
maintain the recreational facilities and activities may be vested
in a public recreation board at the discretion of the governing
body of the City, county or school district. Once established, a
