The Texas Constitution, the laws enacted by the legislature and the decisions reached in the courts of this state provide the framework for how state government should function. Each year, hundreds of political subdivisions throughout the State of Texas turn to the Attorney General for guidance on how to interpret many of these laws. Chapter 402 of the Government Code authorizes the Office of the Attorney General to issue legal opinions that have the effect of law unless overruled by a court. These legal opinions have far-reaching implications not only for all governmental entities within the state but for citizens of Texas as well. Additionally, chapter 552 of the Government Code authorizes the Attorney General to rule on issues specifically relating to access to public records. This year the Office of the Attorney General issued 139 opinions on a wide range of subjects. This index of all the opinions and open records decisions issued during 1994 is provided for your convenience. This index includes a digest of each opinion issued during 1994 as well as a subject index to assist you in finding opinions that have been issued by topic. Also included is a listing of all statutes and constitutional provisions that are referenced in the opinions. The authority to issue legal opinions is one of my principal responsibilities as Attorney General. My Opinion Committee prepares this index of opinions to ensure that the decisions rendered by my office are readily available to the public. If you are interested in following the opinions issued this year, summaries of all opinion requests and of the formal opinions issued by this office are published in the Texas Register.
