Part-time General Sessions Judges in certain counties
QUESTION
May a county legislative body establish and fund
additional part-time general sessions judges?
OPINION
No, T.C.A. 16-15-5003(g) !nerely permits private acts
which would establish part-time general sessions judges in
class 1, 2 or 3 counties.
ANALYSIS
T.C.A. S 16-15-5001 et seq. governs the compensation
and qualifications of general sessions judges. T.C.A. S
16-15-5001(a) divides the counties into eight classes based on
population. T.C.A. S 16-15-5002 provides that judges in class
1, 2 and 3 counties are full-time, whereas judges in classes 4
through 8 are part-time. T.C.A. S 16-15-5003 sets base
salaries based on class and additional compensation based on
extra jurisdiction and class. The pertinent portion of T.C.A.
5 16-15-5003(g) states: 'Nothing in this part shall prevent a
county from establishing and funding the position of a
part-time general sessions judge in a county with a full-time
general sessions judge.
