Published by Authority of Chapter 276
Public Acts of 1971
November, 1991
91-90 CONSTITUTIONAL LAW, TENNESSEE: Reapportionment: The
detachment of any portion of a multi-district county
in the formation of an adjacent multi-county
senatorial district must be justified as necessary in
order to maintain a maximum population deviation below
10%. Likewise, the detachment of any additional
portions of a multi-district county in the formation
of an adjacent multi-county senatorial district must
likewise be justified by the necessity of maintaining
a maximum population deviation of 10%. Tenn. Const.
Art. II, Sec. 6; 1982 Pub. Acts Ch. 909.
91-86 COUNTIES: T.C.A. §47-25-502(3) prohibits trademark
registration of a county seal. It also prohibits
registration of a governmental insignia or any
simulation thereof. A county's seal is, in essence,
already protected from duplication. Thus,
registration of a county seal is unnecessary under the
Tennessee statute even if a county is engaged in
business. 15 U.S.C.A. S1051, 1052; T.C.A. S47-25-501,
502.
91-91 COURTS: Court of Appeals: The subject matter
jurisdictions of the Tennessee Court of Appeals and
Court of Criminal Appeals may be consolidated prior to
the expiration of the 1990-1998 terms of office of the
judges presently comprising those courts and they may
also be consolidated by legislation into a single
appellate court prior to the expiration of the term,
but if the two current courts are abolished and a new
appellate court is created, judicial elections will be
required. Tenn. Const. Art. VI, §1, Tenn. Const. Art
VI, S4, S5, Tenn. Const. Art. VI, S7; T.C.A.
§16-4-106, S16-5-109.
91-91 COURTS: Court of Criminal Appeals: The subject matter
jurisdictions of the Tennessee Court of Appeals and
