90-86    CIVIL PROCEDURE: Writs: Under Tennessee law, neither
a general sessions court nor a juvenile court has the
jurisdiction to issue a writ of mandamus. T.C.A.
§16-11-102, §16-15-401, -501, §17-1-204, §29-25-101,
S§37-1-203, -204.
90-85    COUNTIES: Conission/Commissioners/Legislative
Bodies: Taxing Power: A proposal for a motor vehicle
tax may be placed on the ballot for a county general
or special election by a simple majority vote of the
county legislative body; a two-thirds maj rity vote of
the county legislative body at two consecutive,
regularly scheduled meetings is not required to place
a proposed motor vehicle tax on the ballot in a county
general or special election. T.C.A. §5-8-102; 1978

90-86    COURTS: General Sessions: Juvenile: Under Tennessee
law, neither a general sessions court nor a juvenile
court has the jurisdiction to issue a writ of
mandamus. T.C.A. S§16-11-102, §16-15-401, -501,
§17-1-204, §29-25-101, S§37-1-203, -204.
90-84    DEEDS: Deeds of Trust: The inclusion of a statement
that the amount of indebtedness secured by the
recordation is zero does not affect the validity of
the recording of the instrument or the validity of the
lien created by the instrument. T.C.A. §8-13-108,
§§66-24-101, -102, §67-4-409; Op. Tenn. Atty. Gen.
90-54 (May 11, 1990).
90-87    DEEDS: Registration of Instruments: The provisions
of T.C.A. §13-3-402 forbidding county registers from
receiving, filing or recording a plat of a subdivision
lacking the approval of the regional planning
commissions as set forth in that subsection take
precedence over the general rules for county registers
