ADMINISTRATIVE BOARDS AND AGENCIES: Administrative
Procedures Act: Secretary of State is responsible
for suspending a lobbyist's registration under
T.C.A. S 3-6-110(a) and the Attorney General has
duty to take appropriate action to enforce that
provision; administrative hearing is not required
prior to, or after, suspension of lobbyist's
registration under T.C.A. S 3-6-110; lobbyist who
registers January 1st, but fails to file supplemen-
tary activity report for previous year by January
10, is only subject to suspension for the present
year, and then only for as long as report remains

ADMINISTRATIVE BOARDS AND AGENCIES: Rules: Person who
exercises taxable privilege is considered to be the
taypayer under T.C.A. 5 67-3-601, et seq.,
67-3-901, et seq., and 67-1-707, rather than person
who subsequently purchases tax paid petroleum pro-
ducts; Tenn. Admin. Comp. 1320-7-4-.01(2) is valid
and directs enforcement and application of the
refund provisions of T.C.A. S 67-3-910 but not by
T.C.A. S 67-1-707; refund of taxes not paid in
error as those terms are used in T.C.A.
