RE:   Zarrella v. Town of East Greenwich
Dear Mr. Zarrella:
The investigation into your Access to Public Records Act (APRA) complaint
filed against the Town of East Greenwich (Town) is complete. By letter dated October
10, 2002, you relate that the Town willfully failed to respond to your September 24, 2002
request for information relative to cost overruns on a municipal sewer expansion project.
As a follow-up, by letter dated October 18, 2002, you inform the Department of Attorney
General that subsequent to the filing of your October 10, 2002 complaint, you received a
correspondence from the Town and [a]lthough the Town Manager did address some of
[your] concerns, there remained a few unanswered questions.
In response to your complaint, this Department received a substantive response
from the Town Solicitor, Edmund L. Alves, Jr., Esquire. Mr. Alves relates that:
[a]lthough Mr. Zarrella's request for information is in
interrogatory form and, for the most part, does not seek
public records within the meaning of R.1.G.L. 38-2-2, the
Town Manager has nonetheless responded to the questions.
Mr. Zarrella's only document request appears on the
second page of his interrogatories in which he seeks a copy
of all soil testing reports 'as required by an independent
testing laboratory paid for by the contractor.' The Town
Manager's response   indicates  that  the  technician
performing the soil tests had not yet delivered the reports to
the Town. When the reports have been furnished to the
Town by the independent testing laboratory, copies will be
provided to Mr. Zarrella in a timely manner.
