Dear Attorney General Pine:
I write In response to the State Crime Lab Commission's
(Commission) request for an advisory opinion concerning the
employment status of Dr. Richard C. Wiklason (Ph.D), who is
currently serving as Acting Director of the Stat Crime
Laboratory. More specifically, the Commission questions whether
Dr. Wilkinson's acceptance of a faculty position at URI In July,
1990, deprives him of certain job protections he attained and
enjoys pursuant to R.I. Gen. Laws 136-4-59.
As factual background, a hearing omcer appointed by the
Attorney General has found that Dr. Wilkinson entered State
service on July 26, 1971, in the position of criminologist. It has
been established that as an employee of the State Crime
Laboratory, he Is responsible to and subject to the supervision of
the Commission. See Fidings and Recommendations of Hearing
Omcer, dated Aug 15, 1993. On July 11, 1988, Dr. Wilkinson
attained the protections afforded twenty (20) year State employees
pursuant to R.I. Gen. Laws § 36-4-59. He therefore cannot be
discharged from the position of criminologist, without a showing of
just cause.
