Dear Sheriff Thomas:
*1 Attorney General Mike Moore has received your letter of request and has assigned it to me for research and reply. Your letter states:
*1 Recently I have had some complaints from bail bondsmen reference a case worker that is working at the local correctional facility, which is a
regional correctional facility. My question is this, is it legal for a case worker at the jail to be a bail bondsman or would this be considered a
conflict of interest in your opinion? He has been informed that he has to be called when he is off of facility grounds to make a bond and must be off
duty at the time he makes the bond. Technically, he does not work for the sheriffs office but is hi red by and works for Correctional Management
Systems who hires and controls certain positions at the facility, until their contract expires.
*1 In response, normally the Mississippi Ethics Commission would answer any questions in reference to Mississippi conflict of interest laws which
are codified at Mississippi Code Annotated Sections 25-4-101, et. seq. However, your letter states that the case worker/bondsman is not a
public employee and therefore the Mississippi conflict of interest laws do not apply to him.
*1 This office is not aware of any specific prohibitions against a bondsman from being employed by a private company that contracts to manage
a correctional facility. Such situations may be addressed in any contract between the County/State and Correctional Management Systems.
