In your letters of March 16, 1994, you asked the following questions: FIRST QUESTION: RESPONSE: I requested that you reconsider your answer in an opinion to Circuit Clerk Nancy White Reed on July 23, 1986 which stated that a defendant convicted in Justice or Municipal Court was not required to prepay any criminal appeal cost. In giving your answer, please address pre- payment of filing fees in civil and criminal appeals cases. This office understands the concerns of the circuit clerks in regards to the filing of advanced court cost in criminal appeals from justice and municipal courts. However, this office is compelled to maintain its position as set forth in the opinion addressed to Circuit Clerk Nancy White Reed.
