Box 1307 Natchez, MS 39212-1307 Dear Mr. Forman: Attorney General Mike Moore has received your letter of request and has assigned it to me for research and reply. As attorney for the Natchez-Adams County School District you state: On July 1, 1987, the school district under the authority of Section 29-3-41 of the Mississippi Code of 1972 Annotated, executed a hunting lease to Clermont Hunting Club covering a school section.in Adams County, Mississippi. The lease was for a period of five years and the expiration date was June 30, 1992. As is our custom, the School Board on May 28, 1992, but shortly before the Clermont Hunting Club lease expired, advertised for a new hunting lease on the property. The bids for the new lease were opened at a meeting of the school board on June 11, 1992, and feeling that the three bids for the lease were insufficient, the school board rejected the bids, set a minimum bid of $5.00 per acre for the property, and re-advertised for bids. On the re-advertisement, the Clermont Hunting Club bid $15,500.00 for the lease, whereas the high bidder bid $36,600.00 for the hunting lease. Under the provisions of Section 23-3-41, the existing holder of the hunting rights, if he shall have made an offer, shall have the final right to extend his lease at an annual rental equal to the said highest offer.
