XVII NO.1 JANUARY 5, 1960 COUNTY HOSPITALS: COUNTY COURT: No. 33-59 (Williamson) William E. Gladden Houston, Mo. 11/16/59 The order of-the county court of Texas County made on February 16, 1959, appointing trustees for the Texas County Hospital to fill vacancies resulting from the expira- tion cfthe terms of such trusteeswasa valid order; the limitation to January, 1960, which was a part of the order, was contrary to law and so was invalid. The appoint- ments actually extended until the next general election following February 11, 1959. The county court is not empowered to appoint new trustees in January, 1960. The county court has no power of removal of these trustees prior to the time of termina- tion of their appointments, and a successor can be appointed by the county court only when there is a vacancy on the board of trustees. TAXATION: COUNTY COURTS: PROSECUTING ATTORNEY: No. 97-59 (Williamson) Paul E. Bowling 12/2/59 Williams Green, Mo. The county court in third class county is not authorized to compromise a judgment obtained for the collection of delinquent, tangible, personal property taxes. It is the duty of the prosecuting attorney of a county of the third class to file suits for the collection of such taxes and to charge the fees authorized by Sec. 140.740, RSMo. Cum. Supp. 1957, and upon collection of same to pay such fees to the county treasurer. ELECTIONS: No. 65-59 (Williamson) William C. Myers, Jr. Carthage, Mo. 12/8/59 In re-establishment of voting wards in the city of Carthage, the necessary adjust- ment as to the ward and precinct location of registered voters should be made by a transfer of registration by the county clerk of Jasper County. The cost of such transfer ig borne by Jasper County. SCHOOLS: TAXATION: No. 76-59 (Inglish) Raymond R. Roberts Farmingtonj Mo. 12/15/59 A school district may appear before the State Tax Commission at a hearing on an appeal of assessment and may employ expert witnesses for such purpose. SCHOOLS: COUNTY COURT: No. 89-59 (Inglish) Francis Toohey, Jr. Perryville, Mo. 12/16/59 A county court may not attach unorganized territory to school district not contiguous thereto. DIVISION OF HEALTH: BUREAU OF VITAL STATISTICS: No. 37-59 (williamson) H. M. Hardwicke, M. D. Jefferson City, Mo. 12/24,/59 The Bureau of Vital Statistics may separate the health and medical section of the Standard Certificate of Live Birth from the upper portion of the certificate, and the health and medical section may, after analysis and preservation on IBM cards, be destroyed.
