Winona County Attorney
In your letter to Attorney General Robert W. Mattson,
requesting an opinion of this office, you call attention to L.
1965, c. 746, 4 and L. 1965, c. 841, 2, subd. 5 and 6 and inquire
as to which law is to apply in Winona County.
OPINION
L. 1965, c. 746 is a special law applicable to Winona
County. Section 4 thereof pertaining to various county offices,
including the county auditor, provides as follows:
The board oc ounty commissioners shall by resolution
deterime the number of deputies assigned to each office, and the
numbeir of clerks and other employees required in the performance
of each respectivp office, and shall determine and provide for the
compensation of each.
Under the above provision the board of county commissioners
is directed to determine the number of deputies and the compensa-
tion of each in the office of county auditor. Said section does
not affect the authority of the auditor to appoint deputies as
provided in M.S. 384.08. The latter provides asfbllows:
Any county auditor may be certificate in writing appoint
deputics who, before entering upon their duties, shall file with
the register of doeds such certificates, with their oaths of
office endors :d thereon. Such deputies may sign all papers and
do all other things which county auditors may do. Auditors shall
roquiro bonds of their deputies in such amount and with such
sureties as they do-m proper, shall be responsible for their acts,
and may revoke their appointment at pleasure..
L. 1965, c. 841 is a general law passed subsnouent to the
above special law concerning the offico of county auditor which
in part amends M.S. 384.151 by adding a new subdivision 5 to
provide:
